1. Allgemeines
\n<\/span><\/strong>Ma\u00dfgeblich ist jeweils die zum Zeitpunkt des Vertragsschlusses g\u00fcltige Fassung. Der Vertragsabschluss steht in deutscher sowie englischer Sprache zur Verf\u00fcgung. Die Angebote, Leistungen und Lieferungen von ONEMALDIVIAN erfolgen ausschlie\u00dflich aufgrund dieser Allgemeinen Gesch\u00e4ftsbedingungen, Gesch\u00e4ftsbedingungen des Teilnehmers finden keine Anwendung.<\/span><\/p>\n

2. Vertragsabschluss<\/strong>
\n<\/span>Mit der schriftlichen Best\u00e4tigung von ONEMALDIVIAN kommt der Reisevertrag zustande. Der Vertrag basiert ausschlie\u00dflich auf Angaben und Bedingungen der jeweiligen Reisebeschreibung, sowie in der Reisebest\u00e4tigung. Teilbuchungen von Tauchkursen und Workshops und Aufteilungen zwischen mehreren Teilnehmern sind nicht m\u00f6glich.<\/span><\/p>\n

3. Zahlungsbedingungen<\/strong>
\n<\/span>F\u00fcr alle Angebote f\u00fcr Events, Unterkunft und Transport gelten die im Angebot ausgewiesenen Preise. Mit Vertragsabschluss wird 100% der Kosten f\u00e4llig. Die Informationen zwecks Zahlungsabwicklung werden per Email \u00fcbermittelt. Gehen die Zahlungen auch nach schriftlichen Anmahnungen nicht fristgem\u00e4\u00df ein, ist ONEMALDIVIAN berechtigt, vom Vertrag zur\u00fcckzutreten und Schadensersatz in H\u00f6he der f\u00fcr einen R\u00fccktritt des Teilnehmers entstandenen Pauschalbetr\u00e4ge zu fordern. <\/span><\/p>\n

4. Stornierung \/ Haftung von ONEMALDIVIAN
\n<\/span><\/strong>ONEMALDIVIAN ist berechtigt vereinbarte Tauchkurse, Workshops und Events abzusagen, wenn die Mindestteilnehmer- zahl von 15 Personen nicht erreicht wird; die Stornierung erfolgt in der Regel sp\u00e4testens 30 Tage vor der angek\u00fcndigten Reise in Textform. Bereits geleistete Zahlungen werden dem Teilnehmer erstattet; weitergehende Anspr\u00fcche (mit Ausnahme der Verletzung von Leben, K\u00f6rper, Gesundheit und grobem Verschulden der gesetzlichen Vertreter, Angestellten oder sonstigen Erf\u00fcllungsgehilfen) sind ausgeschlossen.<\/span><\/p>\n

5. Tauchkursbedingungen<\/strong>
\n<\/span>Die Tauchlehrer sind berechtigt, Anfangs- und Endzeiten der Tauchkurse und Workshops nach Bedarf abweichend von der Ausschreibung festzulegen. Die Tauchlehrer sind berechtigt, Vertreter einzusetzen. Alle Tauchkurse und Workshops werden gem\u00e4\u00df der Ausschreibung durchgef\u00fchrt. F\u00fcr die Pr\u00e4sentation der Inhalte ist der Tauchlehrer zust\u00e4ndig. Die Kursteilnehmer verpflichten sich den Anweisungen der Tauchlehrer zu folgen. Insbesondere verpflichten sich die Kursteilnehmer innerhalb der Standards von AIDA International zu tauchen. Der Tauchlehrer kann Personen, die den Tauchkurs oder den Workshop st\u00f6ren oder behindern bzw. den Kursanforderungen nicht gen\u00fcgen, vom Tauchkurs oder Workshop ausschlie\u00dfen. In dem Fall besteht kein Recht auf Erstattung der Kosten. Nachteile aus nicht rechtzeitigem Erscheinen hat der Tauchsch\u00fcler \/ Workshopteilnehmer selbst zu verantworten.<\/span><\/p>\n

6. Tauchkurs Voraussetzungen<\/strong>
\n<\/span>Der Teilnehmer muss sich vor der Teilnahme einer TTU (Tauchtauglichkeitsuntersuchhung) unterziehen. Anhaltspunkte \u00fcber eine m\u00f6gliche Einschr\u00e4nkung der Tauchtauglichkeit lassen sich vorab mit dem Formular Medizinische Selbstauskunft \u00fcberpr\u00fcfen. Dies gibt bereits m\u00f6gliche Hinweise zur Tauchtauglichkeit. Mit der Anmeldung zum Tauchkurs \/ Workshop, best\u00e4tigt der Kursteilnehmer, dass er k\u00f6rperlich nicht eingeschr\u00e4nkt ist und eine g\u00fcltige und positive Tauchsport\u00e4rztliche Untersuchung hat, welche nicht \u00e4lter als 12 Monate ist. Des Weiteren muss der Kursteilnehmer den Haftungsausschluss unterschreiben.<\/span><\/p>\n

7. R\u00fccktritt des Teilnehmers<\/strong>
\n<\/span>Der Teilnehmer kann jederzeit vom Vertrag zur\u00fccktreten; der R\u00fccktritt muss in Textform erfolgen. Eine Ersatzperson f\u00fcr die Teilnahme an dem Event ist nicht zul\u00e4ssig. ONEMALDIVIAN ist berechtigt eine pauschalierte Entsch\u00e4digung zu verlangen. Die pauschalierten R\u00fccktrittskosten betragen f\u00fcr das Event bis 30 Tage vor Beginn des Tauchkurses bzw. des Workshops (Eingang des R\u00fccktritts) 50 % und bei weniger als 14 Tagen vor Beginn des Tauchkurses bzw. des Workshop (Eingang des R\u00fccktritts) 100 % der Kosten.<\/span><\/p>\n

8. Absprachen<\/strong>
\n<\/span>M\u00fcndliche Absprachen sind nur wirksam, wenn sie von ONEMALDIVIAN schriftlich best\u00e4tigt worden sind.<\/span><\/p>\n

9. Salvatorische Klausel<\/strong>
